Terms of Service

Overview

These Terms of Service govern your access to and use of SpeakFlow Academy’s courses, cohorts, coaching, and related materials (the “Services”). By creating an account, enrolling, or using any part of the Services, you agree to these Terms.

If you do not agree, do not use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Using our services

You must be at least 16 and able to enter a contract. Keep your account secure and follow community standards.

  • Provide accurate account information and keep it up to date.
  • Keep your password confidential; you are responsible for all activity under your account.
  • Use the Services only for lawful purposes and in accordance with these Terms.

Accounts and eligibility

  • You affirm that you are at least 16 years of age. If you are 16–18, you represent you have consent from a parent or legal guardian.
  • We may suspend or terminate accounts that violate these Terms or present risk to the platform or community.
  • You may not share, sell, or transfer your account or enrollment access without our written permission.

Course access and content

  • Course materials are licensed for your personal, non-commercial use during the access window stated at purchase.
  • We may update, improve, or retire course modules to maintain quality and relevance.
  • Downloading or redistributing content without permission is prohibited unless explicitly allowed.

Payments and cancellations

Prices are in USD unless stated otherwise. You can cancel up to 48h before a cohort starts for a full refund.

  • Taxes may apply based on your billing address and will be shown at checkout.
  • If a payment fails, we may retry charges and pause access until payment is resolved.
  • For subscriptions, you authorize recurring charges until you cancel. Cancellation applies to future billing periods.

Refunds

  • Full refund: cancel at least 48 hours before the announced start time.
  • Partial refund or credit: if we materially change dates or cancel a cohort, we will offer alternatives or a refund.
  • No-shows or access used beyond the refund window are generally not eligible for refunds.

Rescheduling and transfers

  • One-time reschedule may be available subject to seat availability and notice at least 24 hours before start.
  • Transfers to another learner require our approval before the cohort start and may incur an administrative fee.

Acceptable behavior

  • Be respectful and constructive
  • No harassment or discrimination
  • Keep confidential info private

We may remove content, restrict features, or terminate access for conduct that violates these standards or applicable law.

Intellectual property

  • All course content, documentation, and branding are owned by SpeakFlow Academy or its licensors.
  • You may not copy, record, scrape, publish, or create derivative works without permission.
  • Limited license: non-exclusive, non-transferable, revocable license to use content for personal learning.

Your submissions

You retain ownership of your submissions. By submitting feedback, assignments, or testimonials, you grant us a worldwide, royalty-free license to use, reproduce, and display such content to operate and improve the Services and to market them, unless you opt out by notifying support before publication.

Privacy

We process personal data to provide and improve the Services, comply with legal obligations, and maintain safety. We strive to collect only what we need and retain it for no longer than necessary. See our Privacy Notice for details where applicable.

  • We may use analytics to understand feature usage and performance.
  • We may send service and transactional messages related to your account.
  • You can request access, correction, or deletion where legally available.

Third-party services

The Services may interoperate with third-party tools (for example, payment processors or videoconference platforms). Your use of those tools is subject to their terms and policies. We are not responsible for third-party content or failures.

Disclaimer of warranties

  • The Services are provided “as is” and “as available.”
  • We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not guarantee specific learning outcomes or job placement.

Limitation of liability

  • To the maximum extent permitted by law, SpeakFlow Academy will not be liable for indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim relating to the Services will not exceed the amount you paid for the relevant offering in the 3 months preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless SpeakFlow Academy and its affiliates from claims arising from your use of the Services, your content, or your breach of these Terms.

Changes to the Services or Terms

  • We may change features, content, or availability to improve the Services.
  • We may update these Terms. Material changes will be effective upon posting; continued use signifies acceptance.

Suspension and termination

  • We may suspend or terminate access for violations, risk, nonpayment, or legal reasons.
  • Upon termination, licenses end and you must cease use of the content except as expressly permitted.

Governing law and disputes

  • These Terms are governed by applicable law based on our principal place of business, without regard to conflict of laws rules.
  • Before filing a claim, you agree to try to resolve the dispute informally by contacting support and allowing 30 days to respond.
  • To the extent permitted by law, disputes will be resolved on an individual basis; class actions are waived.

Severability and entire agreement

If any provision is unenforceable, the remaining provisions remain in effect. These Terms, together with any enrollment details presented at checkout, constitute the entire agreement between you and SpeakFlow Academy regarding the Services.
